By creating an account, accessing, or using Atmosly (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you are using the Service on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.
2. Accounts and Access
- You must provide accurate information and keep your credentials secure.
- You are responsible for activity under your account. Notify us immediately of unauthorized use.
- Use must comply with applicable laws and these Terms.
3. Acceptable Use
You agree not to misuse the Service. Prohibited activities include:
- Infringing, illegal, or harmful content or activities.
- Reverse engineering, probing, or circumventing security or usage limits.
- Interfering with Service stability or other customers’ use.
- Uploading malware, secrets, or data you do not have rights to process.
4. Subscriptions, Billing, and Trials
- Paid plans are billed in advance per the plan selected. Fees are non‑refundable except where required by law.
- Trials may be limited and can be modified or terminated at any time.
- Taxes (e.g., VAT/GST) may apply and will be charged as required.
5. Data, Security, and Privacy
- You retain ownership of Your Data. You grant Atmosly a limited license to process it to provide the Service.

- You are responsible for configuring access controls, secrets, and integrations in your environment.

6. Service Levels and Support
We aim for high availability and timely support. Any formal SLAs or support commitments are provided in your order form or subscription plan.
7. Third‑Party Services
Integrations (e.g., Git providers, registries, scanners) are operated by third parties. Use of those services is subject to their terms. Atmosly is not responsible for third‑party services.
8. Intellectual Property
The Service, software, and content are owned by Atmosly and its licensors. No rights are granted except as expressly stated. You may provide feedback; we may use it without restriction.
9. Beta and Preview Features
Beta/preview features may be provided as‑is, may change without notice, and may be subject to additional terms. They are excluded from any SLA.
10. Suspension and Termination
- We may suspend or terminate access for violations of these Terms, legal requirements, or risk to the Service.
- You may cancel at any time; termination does not entitle you to a refund for elapsed billing periods.
- Upon termination, your access ends and we may delete or anonymize data in accordance with our retention policies and law.
11. Disclaimers
The Service is provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non‑infringement. We do not warrant uninterrupted or error‑free operation.
12. Limitation of Liability
To the maximum extent permitted by law, Atmosly and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, revenues, data, or business, arising from or related to the Service. Our aggregate liability is limited to fees paid in the 12 months preceding the claim.
13. Indemnification
You agree to defend, indemnify, and hold harmless Atmosly from claims arising out of your use of the Service, Your Data, or your breach of these Terms or applicable law.
14. Compliance and Export
You will comply with applicable laws, including data protection and export control laws. You represent you are not prohibited from receiving the Service.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the applicable contracting entity jurisdiction (as per your order form or subscription). Courts in that venue have exclusive jurisdiction, except that either party may seek injunctive relief for misuse of IP or confidential information.
16. Changes to the Terms
We may update these Terms from time to time. Material changes will be notified via the Service or email. Continued use after the effective date constitutes acceptance.
